A).- PURPOSE FOR WHICH WE WILL USE YOUR DATA

B).-OF THE PERSONAL DATA WE WILL USE FOR THESE PURPOSES

To carry out the purposes described in this privacy notice, we will use the following personal data: identification, contact, employment, physical, patrimonial, and biometric characteristics.

C).- OF THE TRANSFER OF PERSONAL DATA

SAT (Mexican Tax Administration Service) AND SHCP (Mexican Department of Finance): Compliance with the obligations established in the Mexican Law on this matter.

YOUR BANK: If necessary, to make the appropriate arrangements with these institutions.

We inform you that for the transfers indicated with an asterisk (*), we need to obtain your consent. If you do not express your refusal for such transfers, we will understand that you have given us your permission.

D).-ACCESS, CANCELLATION, RECTIFICATION OR OPPOSITION TO THE USE OF YOUR DATA

You have the right to know what personal data we have about you, what we use it for, and the conditions of the use we give it (Access). Likewise, it is your right to request the correction of your personal information if it is outdated, inaccurate or incomplete (Correction); that we remove it from our records or databases when you consider that it is not being used by the principles, duties, and obligations provided for in the regulations (Cancellation); as well as to oppose the use of your data for specific purposes (Opposition). These rights are known as ARCO rights.

To exercise any of the ARCO rights, you must submit a written request to the PRIVACY DEPARTMENT at the following address: Melchor Ocampo N° 193, Penthouse C Torre C, Plaza Galerías, Veronica Anzures, Miguel Hidalgo, C.P. 11300, Mexico City, Mexico, from 9 a.m. to 2 p.m., Monday to Friday, or to

Such an application must contain at least the following: 

(i) Name of the holder of the personal data; 

(ii) Email address to receive notifications; 

(iii) Documents proving the identity or legal representation of the Data Subject; 

(iv) A direct and precise description of the personal data regarding which the right is sought to be exercised, and that is intended to be applied. 

(v) Any other element or document that facilitates the location of the personal data. If the application does not meet any of the above requirements, the PRIVACY DEPARTMENT may require you within 5 days of receipt of the application to provide the elements or documents necessary to process the form. You will have 10 days to respond to the request. If you do not respond within that time, the corresponding application will be considered not submitted.

The deadlines for attention will be a maximum of 20 days from the date the request is received to communicate the decision made, so that, if appropriate, it will be active within 15 days after the issuance of the response. To protect your confidentiality, CASA KUNDAVI S.A. DE C.V. will send the answer to your request to the email you have provided for this purpose.

E).-REVOCATION OF CONSENT TO THE USE OF YOUR DATA

You can revoke your consent to the processing of your data. Please note, however, that we may not be able to comply with your request or terminate use immediately in all cases, as we may be required by law to continue processing your data. You should also consider that for specific purposes, revoking your consent will mean that we can no longer provide you with the service you requested, or that your relationship with us is terminated.

To revoke your consent, you must submit your request in terms of the above paragraph marked with the letter D.

F).-LIMITATION TO THE USE OR DISCLOSURE OF YOUR PERSONAL INFORMATION

– Your registration in the Public Registry to Avoid Advertising, which is in charge of the Mexican Federal Consumer Protection Agency (Profeco), so that your data will not be used to receive advertising or promotions from goods or services companies.
